DMCA Copyright & IDX Safe Harbor Policy

Jacob Baer respects the intellectual property rights of creators, photographers, and listing brokers. This platform operates as an interactive service provider under the safe harbor guidelines of Title 17, United States Code, Section 512 (the Digital Millennium Copyright Act, or DMCA).
1. DMCA Compliance Declaration
Because this platform automatically indexes, caches, and syndicates real estate imagery via automated IDX data feeds from the REcolorado Multiple Listing Service, external listing data may occasionally populate without our prior manual review. We take copyright concerns seriously and respond promptly to properly formatted takedown notices.
2. Designated Copyright Agent
If you are a copyright holder or an authorized legal agent representing an owner, and you believe in good faith that any photograph, floor plan, rendering, or descriptive text displayed on this website infringes upon your exclusive copyright, you must submit a formal, written Notification of Claimed Infringement to our Designated Copyright Agent:

3. Statutory Notice Requirements (17 U.S.C. § 512(c)(3))
To be recognized as a legally binding, actionable filing, your written Takedown Notice must contain all of the following:
- A physical or advanced electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
- Clear identification of the copyrighted work claimed to have been infringed (such as the original source photograph or a link to your copyright registration certificate).
- Precise identification of the material that is claimed to be infringing and that is to be removed, including the exact URL address of the specific listing page on our site where the image is hosted.
- Information reasonably sufficient to permit Jacob Baer to contact you, including your name, physical address, telephone number, and email address.
- A clear statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Notices that fail to include all six elements may be deemed statutorily defective and will be returned to you for revision before any takedown action is initiated.
4. Response Timeframe
Upon receipt of a valid, structurally complete Takedown Notice, Jacob Baer will immediately remove or disable access to the disputed property imagery and notify the listing source (REcolorado, the listing brokerage, or the originating photographer) of the action taken.
5. Counter-Notification
If a listing client, cooperating agent, or photographer believes that material was removed or disabled in error, they may submit a formal Counter-Notification to our Designated Agent containing:
- Their physical or electronic signature, full name, address, telephone number, and email.
- Identification of the removed material and the location at which the material appeared before it was removed.
- A statement under penalty of perjury that the counter-notifying party has a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- A statement consenting to the jurisdiction of the United States District Court for the District of Colorado, and that they will accept service of process from the complainant.
Upon receipt of a valid Counter-Notification, we will forward it to the original complainant. If the complainant does not file a court action seeking a restraining order within 10–14 business days, the removed material may be restored.
6. Repeat-Infringer Policy
In accordance with the DMCA and other applicable law, Jacob Baer has adopted a policy of terminating, in appropriate circumstances and at his sole discretion, the access of users who are deemed to be repeat infringers.
7. Misrepresentation Warning
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake, may be liable for damages, including costs and attorneys' fees, incurred by the alleged infringer, by any copyright owner or its authorized licensee, or by the service provider. Do not submit false claims.
